Why Change Visa Status from F1 to E2?

Is it possible to change the status of an F1 student visa
to an E2 business visa?

The short answer is Yes.

SEVP modifies temporary exemptions for nonimmigrant students taking online courses during fall 2020 semester
WASHINGTON – The Student and Exchange Visitor Program (SEVP) announced modifications Monday to temporary exemptions for nonimmigrant students taking online classes due to the pandemic for the fall 2020 semester. The U.S. Department of Homeland Security plans to publish the procedures and responsibilities in the Federal Register as a Temporary Final Rule.

Fall 2020 Semester:
Nonimmigrant F-1 and M-1 students attending schools operating entirely online
may not take a full online course load and remain in the United States.

E2 Visa Strategy

In order to stay and work in the U.S. – an E2 Visa strategy can be used. The E2 Visa for business entrepreneurs does not have caps or limitations on number of visas issued.

HOWEVER, this E2 visa status change strategy requires careful planning. It is strongly recommended to work with an attorney who is Board Certified Attorney in Immigration and Nationality Law.

The F-1 Visa (Academic Student) allows you to enter the United States as a full-time student at an accredited college, university, seminary, conservatory, academic high school, elementary school, or other academic institution or in a language training program. You must be enrolled in a program or course of study that culminates in a degree, diploma, or certificate and your school must be authorized by the U.S. government to accept international students.

Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a nonimmigrant visa for temporary stay, or an immigrant visa for permanent residence. You must have a student visa to study in the United States. Your course of study and the type of school you plan to attend determine whether you need an F visa or an M visa.
